§ 1. GENERAL

Participation in competitions on the Instagram page: “mannesmann_werkzeuge” and/or the Facebook page “Brüder Mannesmann Werkzeug GmbH (hereinafter referred to as “the organizer”) is only possible if these conditions of participation are taken into account. The competition is not supported by Instagram or Facebook and is not affiliated with Instagram or Facebook.

§ 2 PARTICIPATION REQUIREMENTS

By participating in the competition, the social media user expressly accepts these general terms and conditions of participation. All natural and legally competent persons with a minimum age of 18 can take part. Employees of the organizer and their relatives are excluded from participation. Participation is only possible via your personal Instagram/Facebook registration (your own Instagram/Facebook account). If the organizer becomes aware of technical manipulation or any other violation of these conditions of participation, he will exclude the participant from the competition. Technical manipulation includes, among other things, the multiple registration of a person, participation via a competition service or similar automated collective participation services. In these cases, the prize can also be subsequently withdrawn and a replacement winner can be drawn. By participating, the participant agrees that if he or she wins, his/her name and/or picture will be published on the Internet. Participation is only possible within the period stated in the competition description. Legal recourse is excluded.

§ 3 PROFIT

The prize will be awarded as advertised in the competition. A change or cash payment of the price is excluded. The winner will be notified by us as described in the competition. If the winner does not respond to the prize notification within the deadline we set, the prize will be forfeited without replacement.

§ 4 LIABILITY

Claims for damages against the organizer in connection with the competition are excluded - within the limits permitted by law - regardless of the legal basis, unless the organizer has intentionally or grossly negligently violated legal obligations. Furthermore, the organizer is not liable for damages resulting from impairment of the availability of the competition website in the event of technical disruptions and force majeure events that cannot be influenced, as well as attacks by third parties against the competition website. However, the organizer will do everything possible to ensure the reliability and functionality of the competition website. Furthermore, the organizer does not guarantee that the competition website will function properly on the respective participant's computer.

§ 5 DATA PROTECTION

As part of this competition, the organizer maintains the highest data protection standards and observes the relevant legal provisions, in particular the EU General Data Protection Regulation (GDPR).

If participants communicate with the organizer as part of this competition via social media (e.g. Facebook, Instagram) (e.g. through comments or sending messages), the legal basis for processing the personal data obtained in this way is the organizer's legitimate interest in the Communication with the participants (Art. 6 Para. f GDPR) and, if necessary, the fulfillment of contractual or pre-contractual obligations (Art. 6 Para. b GDPR). The social networks only provide the organizer with aggregated data that does not allow any conclusions to be drawn about individuals.

The organizer processes the participants' personal data exclusively for the purpose of conducting the competition. After the competition has ended, the data will be deleted. The organizer will not pass on any personal data to third parties.

§ 6 EARLY TERMINATION OF THE COMPETITION

The organizer reserves the right to change the competition components, cancel or end the competition without prior notice due to unforeseen circumstances. The latter applies in particular if errors in the software and/or hardware occur and/or other technical and/or legal reasons influence or make the regular and proper implementation of the competition impossible.

§ 7 SEVERABILITY CLAUSE

If individual provisions of these terms and conditions of participation are invalid or there is a gap in the regulations, this will not affect the effectiveness of the remaining provisions. The ineffective or missing provisions will be replaced by a provision that comes closest to the purpose of the contract and the legal provisions.

§ 8 JURISDICTION / APPLICABLE LAW

In the event of disputes, German law applies exclusively. The place of jurisdiction is, to the extent permitted by law, the organizer's registered office. If the participant does not have a general place of jurisdiction in Germany or moves abroad after participation, the organizer's registered office is also agreed as the place of jurisdiction. Legal recourse is excluded.

§ 9 SELECTION PROCESS

The winner will be determined by lottery. Legal recourse is of course also excluded here.
